Please read these terms carefully before using the services of our application. By using our application, you agree to be bound by these terms.

Personal Information:

We collect your personal information to offer and continuously improve our services.
You will find below the types of personal information we collect.

  • Information you provide to us
    We collect and record all information you provide to us via the application. You can choose not to provide us with certain information; however, this decision may deprive you of the use of the application.

  • Information collected automatically
    We automatically collect and record certain types of information regarding your use of the application, such as information related to your use, including your interaction with other users.

  • Information from other sources
    We may also receive other information about you from communications users have with you via the application.

  • Communicate with you.
    We use your personal information to communicate with you.

We disclose customer account content and other personal information when we are legally required to do so or if such disclosure is necessary to enforce and apply our General Terms and other agreements, or to protect the rights, property, or safety of the application, our users, or other people. This includes exchanging information with other companies and organizations for the purpose of fraud protection or improving our application.

We recommend that you use a unique password for your account that is not used for other online accounts, and never share it.

Our application does not use advertising at this time.

Your account information can be viewed or modified from the “My Account” section of the application.
Are children allowed to use the application?
If you are under 18 years old, you may not use our application, nor have an account within the application.
How long do we keep your personal information?
We retain your personal information to allow you to best use our application, for the duration necessary to achieve the relevant purposes under the conditions described in these rules, for the duration necessary to fulfill legal obligations such as tax or accounting obligations, or for any other duration that may have been communicated to you.
Information Collected
All information you provide to us when using the application, namely messages sent through the application, your GPS coordinates at the time of the scheduled delivery, application notifications, and others.
The cost of using the internet
The application requires an internet connection to function, whether WiFi or a mobile data connection. We are not responsible for the costs associated with this internet connection.

GENERAL TERMS AND CONDITIONS OF USE AND SERVICE

We reserve the right to modify or change these terms if necessary.

GENERAL TERMS OF USE

You must not frame or use framing techniques to embed any trademark, logo, or other commercial information (including images, text, layouts, or forms) from our application without our written consent. You must not use meta tags or any other “hidden text” using the name or trademarks of our company or our application without our written consent.

ROLE OF DELIVREX GO
The DelivrEx Go application allows a service requester and a delivery person, both third parties, to connect. Although the application facilitates transactions between people, it is neither the buyer nor the deliverer of the requested products. We are not responsible for the purchase or the delivery conditions (place, date, etc.). The application allows a transaction to be concluded between the service requester and a third-party delivery person, the transaction details, the place and date of delivery; we are not a party to such a transaction and assume no liability arising from such a transaction or resulting from this transaction. We are neither the agent nor the representative of the application’s users. The service requester and the delivery person are solely responsible for their use of the application and the conduct of the transaction.

1. YOUR ACCOUNT
When using your account, you are responsible for maintaining the confidentiality of your account and password, restricting access to your account, and to the extent permitted by applicable law, you agree to be responsible for all activities that have been conducted from your account or with your password. You must take all necessary measures to ensure that your password remains confidential and secure, and must change it immediately if you have reason to believe that your password is known to someone else, or if the password is used or likely to be used in an unauthorized manner. You are responsible for the validity and completeness of the information you have provided to us, and must inform us of any changes regarding this information. Any incorrect information may result in the closure of your account.
You must not use the services of our application: in a way that would cause, or would be likely to cause, an interruption, damage, or impairment to our application, or for fraudulent purposes, or in connection with a crime or illegal activity, or with the intent to cause disturbance, nuisance, or anxiety.
We reserve the right to refuse access, block and/or close an account, remove or modify content if you are in violation of applicable laws, these Terms of Use, or any other terms, conditions, guidelines, or policy of the application.
Users of this application must comply with the entire regulations and must be of legal age, in very good mental health, and possess a payment method in their name.
We reserve the right to ask you for one or more justifications to keep your account active, failing which we may block or delete your account. We may block and/or delete your account if we deem it necessary for the security of the application and/or users.
If your account is inactive for a long period, we reserve the right to block and/or delete it even if you have an ongoing transaction, which will result in the loss of any ongoing financial expenses and/or merchandise concerning you.
We reserve the right to remove any advertisement and/or transaction if we deem it inappropriate or harmful to our regulations.

2. COMMENTS, CRITICISMS, COMMUNICATIONS, AND OTHER CONTENT
Application users can upload comments or any other content, submit suggestions, ideas, questions, or any other information as long as this content is not illegal, obscene, abusive, threatening, defamatory, slanderous, infringing on intellectual property rights, or harmful to third parties or objectionable and does not consist of or contain computer viruses, political activism, commercial solicitations, email chains, mass mailings, or any other form of “spam.” You must not use a false email address, impersonate a person or entity, or lie about the origin of a payment method or content. We reserve the right to remove any such content and block and/or delete the responsible account. If you believe that content or an advertisement on our application contains such language, please report it to us via the complaints section within the application.
If you post anything about our application on any medium (newspaper, television, social networks, or others), be it comments, questions/answers, or any other content, you grant us a non-exclusive, royalty-free license to use, reproduce, publish, make available, translate, and modify this content worldwide, and you grant us the right to use the name you have used in connection with this content.
You declare and warrant that you are the owner or have the necessary rights to the content you post; if the content infringes on a third party in any way, you agree to indemnify us in the event of action by that third party against us.

3. SOFTWARE TERMS
In addition to these Terms of Use, conditions apply to all software or applications (including updates or evolutions of the software or application and all related documentation) that we make available for your use of the application.

4. OUR LIABILITY
We will do our best to ensure smooth application operation and error-free internet transmission; however, due to the nature of the internet, this cannot be guaranteed. Furthermore, your access to the application may occasionally be suspended or limited to allow for repairs, maintenance, or to add a new feature or an application update. We will strive to limit the frequency and duration of these suspensions or limitations.
We are not responsible for direct, indirect, or consequential losses caused by a third party using our application.
We shall not be liable for your inability to fulfill your obligations under these terms.

5. MODIFICATION OF THE SERVICE OR TERMS OF USE
We reserve the right to make changes to any service offered, to our application, our application fees, our procedures, our terms and conditions, including these Terms of Use and Service at any time. You are subject to the terms and conditions, procedures, and Terms of Use and Service in force at the time you use the application. If a provision of these Terms of Use and Service is deemed invalid, void, or unenforceable for any reason, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

6. WAIVER
If you violate these Terms of Use and we take no action, whether inadvertently or not, we may still do so at the appropriate time and we would still be entitled to use our rights and remedies in any other situation where you violate these Terms of Use.
7. MINORS
The use of our application is strictly reserved for adults, in very good mental health, and possessing a payment method in their name.
Minors are not allowed to use our application.
8. CURRENCY
The only currency used in the application is the “Euro” “€”.
9. UPDATES
To keep our application up to date, we may offer automatic or manual updates at any time and without prior notice.
10. USE OF A VPN
The use of third-party software such as a VPN with our application may distort information related to the proper functioning of the application and is therefore strictly prohibited.

11. PROCEDURE FOR NOTIFICATION TO REPORT ABUSIVE OR DEFAMATORY CONTENT
You can use the dedicated complaints field to inform us of abusive or defamatory content concerning you or a published product, specifying the user concerned by this accusation. This user will be blocked after verification of their content.

ADDITIONAL CONDITIONS OF OUR APPLICATION
1. Use of our application
You may use the DelivrEx Go application and our software solely for the purpose of allowing you to use and enjoy these services, and as authorized by the Terms of Use, Application Conditions, and Service Conditions. It is prohibited to integrate all or part of a DelivrEx Go program or software into your own programs, to compile all or part of a DelivrEx Go program or software with your own programs, to transfer all or part of a DelivrEx Go program or software for use with another service, to sell, rent, lend, distribute, or sublicense all or part of our DelivrEx Go program or software or transfer any rights to all or part of this application. You may not use our application or DelivrEx Go software for illegal purposes. We reserve the right to terminate any use of our DelivrEx Go software and application and withdraw your usage rights at any time. If you do not comply with these Terms, the Terms of Use, and all Service Terms, the usage rights of a DelivrEx Go application or software granted to you will be automatically withdrawn without prior notice. Our DelivrEx Go application or software is our property and is protected by computer program protection laws and copyright.

2. Use of third-party services.
When you use our application, you may also use the services of one or more third parties, such as a mobile operator or a mobile platform provider. The use of these third-party services may be subject to the policies, terms of use, and fees of these third parties.
3. Reverse engineering prohibition.
You may not and you will not encourage, assist, or authorize anyone to (i) copy, modify, or otherwise alter our application in whole or in part, create derivative works from or of our application, or reverse engineer, decompile, or disassemble our application in whole or in part, except to the extent permitted by law.

GENERAL SERVICE CONDITIONS

DEFINITION OF SOME WORDS IN THE APPLICATION:

  • “User”: Service Requester/Delivery Recipient.

  • “Delivery Person”: Buyer of the product(s) requested by the user, and Deliverer of this/these product(s) to the user.

  • “Advertisement”: Request for product(s) entered by the user wishing to purchase them and have them delivered by a delivery person. This advertisement will be published after the user’s payment.

  • “Transaction”: Published advertisement that has been accepted by a delivery person. It is like an agreement between the two parties, the user and the delivery person.

  • “Delivery Person’s Commission”: Amount of money promised to the delivery person for their purchasing and delivery services provided.

  • “Usage Fees”: Costs of using the application and those of the bank.

You can view your notifications by pressing the bell in the top right corner of the home page.
You can access the details of your advertisements, your transactions, as well as your account by pressing the “My Account” button at the bottom right of the home page.

1. HOW TO ORDER

Requester “Recipient”

Have one or more products purchased and delivered:

  • Main Menu:
    If you wish to purchase one or more products (limit of 5 different products with their quantities) and have them delivered, you must select “User” in the characters at the top of the main menu. You will be redirected to the product description page.

  • Description of the product(s):
    At this point, you must perfectly describe each product you want with all its details: Name, photo, and link where the product can be confirmed, as well as the price and desired quantity (this quantity is limited to 10), and optionally, if you wish, you can indicate the place where the desired product can be obtained and add additional information about it. So you must make the requested product(s) perfectly known.

  • Add another product:
    If you want to add another product, you must press the “Add Product” button, and then add the desired product as before. You are allowed to request a maximum of 5 products per advertisement.
    Once you have entered all the products you desire (maximum of 5 products), you can confirm them with the “That’s All” button.

  • Page regarding commission and delivery:
    You will be redirected to another page where you must mention:

    • Delivery Person’s Commission: This is entered by you and will include the purchasing and delivery service for the previously entered product(s). The minimum delivery person’s commission is 1.0 €.

    • Once done, the amount you must give to the delivery person upon delivery will be displayed, and it will include the sum of your requested products + the delivery person’s commission.

    • The application usage fees are automatically calculated based on the sum of your requested products and are displayed directly. These fees must be paid for your advertisement to be published and visible in the application. Under no circumstances are the fees refunded.

    • Delivery Address: The place where you wish to receive what you have requested from the delivery person.

    • Delivery Person’s Gender: The gender of the delivery person who will be able to see your advertisement: “Male”, “Female”, or “Both”.

    • Advertisement Acceptance Deadline: Your advertisement will be visible and published from the moment you finalize your advertisement until this acceptance deadline. If no delivery person accepts this advertisement during this period, the advertisement is removed from publication and will no longer be visible. An “Expired” label is displayed next to your advertisement in the “My Account – Published” section. The acceptance deadline must be at most one year from the day the advertisement is posted.

    • Delivery Deadline: If the delivery person accepts your advertisement and exceeds this delivery deadline mentioned by you, you will receive a form that you must fill out and validate. If after verification by the administrator it turns out that the delivery person is at fault, they will either receive a warning or be blocked and will no longer be able to use our application. The delivery deadline must be at most one year from the day the advertisement is posted.

    • Please note that the acceptance and delivery deadlines are related to the delivery city mentioned.

  • Advertisement summary and payment page:
    At this stage, you will be redirected to a page summarizing the details of your advertisement. You must accept the regulations and the general terms and conditions of use and service by checking the appropriate box to proceed to payment. This payment includes the sum of the application fees as well as any bank fees if they exist.
    Once the payment is made, you will no longer be able to cancel your request (advertisement). Your advertisement will be published and visible to any delivery person using the application who has chosen the delivery city you mentioned as the destination and who is part of the gender (sex) entered in your advertisement.
    You can view your advertisement in the “My Account – Published” section.

  • Advertisement change proposal:
    You may receive a proposal from a delivery person to modify one of the following elements (product of the advertisement): photo, web link, price and quantity, overall commission, and delivery location. Your advertisement is no longer visible to delivery persons until you accept or refute this proposal.

  • Acceptance or refutation of advertisement change proposal:
    If you refuse the delivery person’s proposal, your advertisement will be visible again to delivery persons as it was before.
    If you accept the delivery person’s proposal and pay a difference if necessary, your advertisement becomes a transaction between you and this delivery person. You will have the delivery day and time stipulated by the delivery person; this date will be between the advertisement acceptance date and the delivery deadline stipulated by you. You must respect the delivery day and time planned by the delivery person.

  • Acceptance of your advertisement by a delivery person (Ongoing Transaction):
    If your advertisement is accepted by a delivery person without them submitting a change proposal, it becomes a transaction between you and this delivery person. You will have the delivery day and time stipulated by the delivery person; this date will be between the advertisement acceptance date and the delivery deadline stipulated by you. You must respect the delivery day and time planned by the delivery person.
    All ongoing transactions can be viewed in the “My Account – Ongoing” section.

  • Send and receive messages between you and the delivery person:
    You will be able to exchange messages with your delivery person by pressing the “Chat” button of the transaction.

  • Validation and finalization of the transaction:
    If the delivery deadline has not been exceeded, you can confirm and validate the transaction at the time of delivery. You must enter the 10-character code in the dedicated field after pressing the “Code” button. This code is visible on the delivery person’s transaction summary page; they must communicate it to you for you to enter it and thus finalize the transaction. Ensure you have a good internet connection to finalize the transaction. Once the correct code is entered, a confirmation page will be visible to you.

  • Planned delivery date exceeded and transaction not finalized:
    If the planned delivery date is exceeded without the correct code being entered before, a questionnaire will be sent to you. You must answer and validate this questionnaire, failing which it will be judged as a breach of contract on your part. You can also send a complaint via the “Complaint” button in the “My Account” section.
    The transaction at this stage is still ongoing, so you can finalize it with the delivery person at any time by entering the transaction validation code. You cannot validate the transaction if the delivery deadline has been exceeded.

  • Delivery deadline exceeded and transaction not finalized:
    If the delivery deadline is exceeded without the correct code being entered before, the transaction cannot be finalized by you. You can send a complaint via the “Complaint” button on the transaction page. The administrator will judge the party at fault and finalize this transaction when appropriate.

  • Evaluation:
    You can evaluate the application and the delivery person after the transaction is finalized. You can only make one evaluation of the application and the delivery person per transaction. The evaluation and comments left are visible to other application users.

As a user, you can request, publish, several advertisements if you wish.

2. HOW TO DELIVER

Delivery Person

Purchase one or more product(s) and deliver it/them:

  • Main Menu:
    If you wish to earn a commission for your service of purchasing one or more product(s) (limit of 5 different products with their quantities) and delivering it/them, you must select “Delivery Person” in the characters at the top of the main menu. You will be redirected to your destination page.

  • Your Destination:
    On this page, you must describe the address of your destination, which will be the delivery city, then press the “Show List” button.

  • Requester (Recipient) Advertisements:
    Once the previous step is done, you will have all the requests, the advertisements, from this destination (delivery) city left by users wishing to have one or more products; you will also have for each advertisement the exact delivery address in your destination city, your commission, and other advertisement details.

  • Advertisement Rankings:
    You will have the possibility to sort these advertisements by publication date, user rating, display duration, delivery deadline, total price of the product(s), or by commission.

    • Sort by Publication Date: This is the default sorting value. Pressing it will show the latest advertisements to the oldest (most recent to oldest). You can reverse this sorting by pressing the Switch button located in the upper right corner.

    • Sort by User Rating: Pressing it will show advertisements sorted by best-rated users to least-rated users. Ratings are calculated by appreciation or not from other users. Users who are not rated will be last. You can reverse this sorting by pressing the Switch button.

    • Sort by Display Duration: This is the sorting by the advertisement’s acceptance deadline. Once the acceptance deadline is passed, or someone else has accepted this advertisement, you will no longer see it. Pressing “Display Duration” will give you a ranking of advertisements that will soon be unavailable to advertisements that still have time to be accepted. You can reverse this sorting by pressing the Switch button.

    • Sort by Delivery Deadline: Pressing it will show advertisements with the closest delivery deadline to those with the furthest delivery deadline. You can reverse this sorting by pressing the Switch button.

    • Sort by Total Price of Product(s): This is the descending sort of advertisements by the total price of the requested product(s). You can specify a maximum total price in the notch under the total price. You can reverse this sorting by pressing the Switch button.

    • Sort by Commission: This is the descending sort of advertisements by Delivery Person’s Commission (your commission). You can specify a minimum commission in the notch under the commission. You can reverse this sorting by pressing the Switch button.

  • Advertisement Summary:
    By selecting an advertisement, you will have a summary with all its details. You can either:

    • Accept the advertisement by pressing the “Accept” button, and after accepting the regulations and the general terms and conditions of use and service by checking its box, you will be redirected to the page where you must specify the delivery date and time. This date must be between the day of acceptance and the delivery deadline. Please note that the delivery day and time are related to the delivery city. Once the advertisement is accepted, the transaction will be ongoing and you will no longer be able to cancel it.

    • Propose a modification to the requester of one of the following elements (product of the advertisement): photo, web link, price and quantity, overall commission, and delivery location; by pressing the “Propose” button and after accepting the regulations and the general terms and conditions of use and service by checking its box; you will be redirected to the advertisement change page. You must change at least one element of the advertisement and specify the reason for the change in the dedicated field. Upon confirming your proposal, you will be redirected to the page where you must specify the delivery day and time and then proceed to the guarantee payment as mentioned previously. After that, either the transaction is accepted by the user with your changes and it will be ongoing, or your changes are refused by the user and you will receive a notification confirming this.

  • Ongoing Transactions:
    Once the transaction is ongoing, you will be redirected to the transaction summary page. You can no longer withdraw and you must honor your commitment to purchase the requested product(s) of the transaction and deliver it/them on the day and time mentioned by yourself. You will receive an exchange code for this transaction (the yellow dial). This code must be entered by the recipient of the advertisement upon delivery to confirm and validate its proper completion. At this stage, the advertisement you accepted (transaction) as well as all other accepted advertisements (transactions) are visible in the “My Account – Ongoing – As Delivery Person” section.
    You must respect the delivery day and time mentioned in the application (mentioned by you). You can request a change of the planned delivery day and time by sending a request to the recipient via the button dedicated for this purpose, “Change Delivery Date”. The recipient must accept it for it to be actually changed, but if they refuse or do not respond, you must comply with the previous day and time.

  • Send and receive messages between you and the recipient:
    You will be able to exchange messages with the requester (recipient) by pressing the “Chat” button on the transaction page. Changing the delivery date and time will not be taken into account via messages; it will only be taken into account if you make a request to them via the application using the dedicated button “Change Delivery Date”, and of course if the recipient accepts this change.

  • Validation and finalization of the transaction:
    During delivery (before the delivery deadline), you must show the recipient the 10-character code displayed in the transaction summary (Code framed in yellow). The recipient must enter it to finalize this transaction. Once the correct code is entered by the recipient, you will receive a notification of the transaction’s finalization. You must have a good internet connection to receive this notification.

  • Planned delivery date exceeded and transaction not finalized:
    If the planned delivery date is exceeded without the correct code being entered by the recipient, a questionnaire will be sent to you. You must answer and validate this questionnaire, failing which it will be judged as a breach of contract on your part. You can also send a complaint via the “Complaint” button in the “My Account” section.
    The transaction at this stage is still ongoing, so you can finalize it with the recipient at any time by having them enter the transaction validation code. You cannot validate the transaction if the delivery deadline has been exceeded.

  • Delivery deadline exceeded and transaction not finalized:
    If the delivery deadline is exceeded without the correct code being entered by the recipient, the transaction cannot be finalized. You can send a complaint via the “Complaint” button on the transaction page. The administrator will judge the party at fault and finalize this transaction when appropriate.

  • Evaluation:
    You can evaluate the application and the requester (recipient) after the transaction is finalized. You can only make one evaluation of the application and the requester (recipient) per transaction. The evaluation and comments left are visible to other application users.

As a delivery person, you can accept several advertisements if you wish; it is up to you to honor each of these transactions.

3. BREACH OF CONTRACT

Cases of breach of contract

“Breach of contract” means failure to respect the planned delivery day and time. This also includes damage to the item(s) during transport or simply non-compliance with these general terms and conditions of use and service.
Breach of contract may result in a poor evaluation, which will be seen by all application users, and/or the temporary or permanent suspension of your account.

  • Breach of contract by the Requester “Recipient”:
    If the contract is not respected by the requester “recipient”, cancels, is late, or does not show up at the meeting place at the time of delivery or for any other reasons, they must reach an agreement with the delivery person to finalize this transaction between them. Under no circumstances will the fees be refunded.
    The delivery person will receive the sum of the product(s) as well as their commission mentioned by the requester, after their transaction is definitively closed.

  • Breach of contract by the Delivery Person:
    If the contract is not respected by the delivery person, cancels, is late, or does not show up at the meeting place at the time of delivery or for any other reasons, they will lose the sum of the delivery person’s commission stipulated by the requester and will not be reimbursed for the sum of the purchased product(s). They must reach an agreement with the requester “recipient” to finalize this transaction between them.

Other conditions:
Items “merchandise”:
Any product requested on our application must comply with regulations and not be an illicit product. Any merchandise prohibited by transport authorities is prohibited on the application: such as narcotics, dangerous substances, counterfeits, weapons and ammunition, protected products, etc. Each country has prohibited or regulated merchandise. Any prohibited product is strictly forbidden to request and/or display on our application. We are neither responsible for nor guarantee the product mentioned or requested on our application, whatever it may be.
Application users can only request articles or products for personal use, never for commercial purposes. We are not responsible for the commercial purchases of users and/or delivery persons.
The application is not responsible for customs surcharges or any additional fees throughout the transaction. The delivery person must understand that the purchased product(s) risk being taxed at the border of the destination country or another country; the delivery person must inquire before accepting an advertisement. The delivery person assumes full responsibility during the transport of the product(s) they are carrying.
The delivery person assumes full responsibility for the integrity of the transported merchandise. We do not guarantee against breakage or any kind of damage concerning the merchandise.
Therefore, every delivery person is entirely responsible for the merchandise in their possession, for its transport, regarding customs control or other authority, for customs tax or other fees until its restitution to the requester. We are neither responsible for nor guarantee this merchandise, whatever it may be, vis-à-vis the requester or the delivery person.

Transaction Backup:
All notifications, messages, and transactions on the application are saved on our servers for a period of 7 days after the transaction is finalized. After this period, these archives will be permanently deleted from our database; except in cases where we deem it necessary to keep them longer.
Complaint:
Any complaint must be made within a maximum period of 48 hours after the planned delivery date. Exceeding this period, without filing a complaint, will be judged as a breach of contract in the case where the transaction is not finalized.

Evaluation and Reviews:
Each user can evaluate their counterpart at the end of the transaction. A rating of 1 to 5 stars can be given to this counterpart, as well as a review concerning them.
The application gives an average of a user’s appreciation based on the ratings from other users concerning them.
The application is not responsible for the evaluation of application users. These evaluations come from other users who have had a transaction together.
These evaluations and reviews are saved and archived. However, we may delete a user’s evaluation for various reasons such as the user’s inactivity for a long duration, inappropriate, abusive, or unacceptable remarks, or if we deem it necessary.

Each user can evaluate the application at the end of the transaction. A rating of 1 to 5 stars can be given to the application, as well as a review. These evaluations and reviews may not be visible on the application and its website.

Each user can give suggestions for improvements or other regarding the application by clicking on the corresponding button “Suggestions”.
