Information you provide to us<\/strong><\/p><p>We collect and store all the data you enter in the application.<br \/>You may choose not to provide certain information, but this may limit your access to some features of the application.<\/p><p><strong>1.2. Information collected automatically<\/strong><\/p><p>We automatically collect certain data related to your usage, including:<\/p><ul><li>your interactions with the application;<\/li><li>your interactions with other users;<\/li><li>technical information related to your device.<\/li><\/ul><p><strong>1.3. Information from other sources<\/strong><\/p><p>We may receive information about you through your interactions with other users or via certain third-party services integrated into the application.<\/p><p><strong>1.4. Communications<\/strong><\/p><p>Your personal information may be used to communicate with you.<\/p><p><strong>1.5. Automated processing<\/strong><\/p><p>Some features of the Application rely on automated data processing (listing ranking, display of ratings, technical filtering, suggestions).<br \/>These processes aim solely to improve the operation and relevance of the services.<br \/>No automated decision produces significant legal effects or individually affects the user\u2019s rights without the possibility of human intervention.<\/p><p><strong>1.6. Purposes and legal basis for processing<\/strong><br \/>Personal data is processed in order to enable the use of the Application, account management, the connection between Users and Couriers, transaction processing, service security, fraud prevention, complaint handling, and compliance with legal obligations.<br \/>Depending on the case, such processing is based on:<br \/>\u2022 the performance of the contract between the user and DelivrEx Go;<br \/>\u2022 compliance with legal obligations;<br \/>\u2022 DelivrEx Go\u2019s legitimate interest in ensuring the security, proper functioning, and improvement of the Application;<br \/>\u2022 the user\u2019s consent where required, in particular for geolocation, access to the camera, or access to the gallery.<\/p><ol start=\"2\"><li><strong> Disclosure of personal information<\/strong><\/li><\/ol><p>We may disclose certain personal data:<\/p><ul><li>when required by law;<\/li><li>to enforce our Terms and other policies;<\/li><li>to protect the rights, safety, and property of DelivrEx Go, our users, or third parties;<\/li><li>for fraud prevention or to improve our services.<\/li><\/ul><p>Such disclosure may include exchanges with partners and organizations specialized in security or fraud prevention.<\/p><p><strong>2.1. Service providers and processors<\/strong><\/p><p>DelivrEx Go may use technical, hosting, payment, messaging, support, analytics, or security service providers acting as processors or service providers, strictly to the extent necessary for the provision and security of the Application.<\/p><p>These providers may have access to certain personal data only to the extent necessary to perform their duties and in accordance with applicable regulations.<\/p><p><strong>2.2. Hosting and possible data transfers<\/strong><\/p><p>Certain data may be hosted, processed, or transmitted through technical service providers located in different countries, including outside the user\u2019s country of residence.<\/p><p>Where required by applicable regulations, DelivrEx Go endeavors to ensure that appropriate safeguards govern such processing.<\/p><ol start=\"3\"><li><strong> Account security<\/strong><\/li><\/ol><p>We recommend that you:<\/p><ul><li>use a strong and unique password;<\/li><li>never share your password;<\/li><li>change it as soon as you suspect unauthorized use.<\/li><\/ul><ol start=\"4\"><li><strong> Advertising<\/strong><\/li><\/ol><p>The application does not use any advertising at this time.<\/p><ol start=\"5\"><li><strong> Access and modification of your data<\/strong><\/li><\/ol><p>You can view or modify your personal information in the <strong>\u201cMy Account\u201d<\/strong> section.<\/p><p><strong>5.1. User rights (access, rectification, deletion, objection, restriction, portability)<\/strong><\/p><p>In accordance with applicable data protection laws, you have the following rights:<\/p><ul><li><strong>Right of access:<\/strong> obtain confirmation that we process your data and receive a copy of your personal information;<\/li><li><strong>Right of rectification:<\/strong> request the correction of inaccurate or incomplete data;<\/li><li><strong>Right to erasure (right to be forgotten):<\/strong> request deletion of your data, within the limits permitted by law;<\/li><li><strong>Right to restriction of processing:<\/strong> request the suspension of data processing in certain cases;<\/li><li><strong>Right to object:<\/strong> object, for legitimate reasons, to processing that concerns you;<\/li><li><strong>Right to data portability:<\/strong> obtain your data in a structured, commonly used, machine-readable format, when applicable.<\/li><\/ul><p><strong>Exercising your rights:<\/strong> You may exercise these rights through the \u201cMy Account\u201d section or by contacting us at <a href=\"mailto:contact@delivrexgo.com\">contact@delivrexgo.com<\/a>. For your security, reasonable proof of identity may be required before processing your request.<\/p><p><strong>Response time: <\/strong>We will respond within one (1) month from receipt of your request. This period may be extended by two (2) additional months in case of complexity or a high volume of requests; you will be informed of any extension within the first month.<\/p><p><strong>5.2. Account deletion and residual retention<\/strong><\/p><p>Deleting the account by the user results in the deactivation of access to the service.<\/p><p>However, certain data may be retained for the period strictly necessary to comply with legal obligations, prevent fraud, resolve disputes, handle complaints, or protect DelivrEx Go\u2019s rights.<\/p><ol start=\"6\"><li><strong> Access by minors<\/strong><\/li><\/ol><p>Use of the application is <strong>strictly prohibited for individuals under 18 years old.<\/strong><br \/>Minors may neither create an account nor use the services.<\/p><ol start=\"7\"><li><strong> Data retention period<\/strong><\/li><\/ol><p>We retain your data for as long as necessary to fulfill the purposes for which it was collected (service provision, security, complaint handling, legal obligations).<\/p><p>Data related to notifications, messages, and transactions is retained for <strong>at least 7 days<\/strong> after completion; it may be retained longer when necessary for the purposes listed (e.g., legal compliance, fraud prevention, dispute resolution).<\/p><p>When the purposes are fulfilled and no legal or operational need justifies extended storage, your data is securely deleted or anonymized.<\/p><ol start=\"8\"><li><strong> Data collected<\/strong><\/li><\/ol><p>Information that may be collected includes, in particular:<\/p><ul><li>messages sent through the application;<br \/>\u2022 the geolocation of the User and the Courier when necessary for the performance of a delivery;<br \/>\u2022 photos taken using the user\u2019s device camera as part of the use of the application (in particular for listings or exchanges);<br \/>\u2022 images imported from the device gallery;<br \/>\u2022 notifications and internal interactions;<br \/>\u2022 all data related to the use of the application.<\/li><\/ul><p>Location data is collected only when necessary for the performance of a delivery, with the user\u2019s explicit authorization, and only for the duration strictly necessary to perform the service.<\/p><p>Clarification on geolocation:<br \/>Location data is used solely for the purposes of providing the service, including matching users, delivery operations, and transaction security.<br \/>DelivrEx Go does not perform permanent tracking of the user\u2019s location nor any advertising profiling based on geolocation.<\/p><p>Access to the camera and gallery is used only when necessary for the functionalities of the application, with the user\u2019s prior authorization.<\/p><p><strong>8.1 Consent and technical permissions<\/strong><br \/>By using the Application, the user acknowledges and agrees that DelivrEx Go may access certain features of the user\u2019s device, where strictly necessary for the operation of the service, including location (GPS), the device camera, and the photo gallery.<br \/>Access to these features is subject to the user\u2019s prior authorization through the device settings.<br \/>Refusal or withdrawal of these permissions may limit or prevent the use of certain features of the Application.<\/p><p><strong>8.2 Consequences of refusing or withdrawing permissions<\/strong><br \/>If the user refuses or withdraws necessary permissions (such as geolocation, camera, or gallery access), certain essential features of the Application may be limited, degraded, or unavailable.<br \/>DelivrEx Go shall not be held liable for any limitations resulting from the refusal or withdrawal of such permissions.<\/p><ol start=\"9\"><li><strong> Internet usage cost<\/strong><\/li><\/ol><p>The application requires an Internet connection (Wi-Fi or mobile data).<br \/>Costs associated with this connection are your responsibility.<br \/>DelivrEx Go cannot be held responsible for such fees.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p><strong>TERMS OF USE (TOU)<\/strong><\/p><p>These Terms of Use (\u201cTOU\u201d) govern access to and use of the <strong>DelivrEx Go<\/strong> application (hereinafter \u201cthe Application\u201d). By accessing or using the Application, you agree to be bound by these TOU. If you do not accept these TOU, you must not use the Application.<\/p><p><strong>Article 1 \u2014 Purpose and scope<\/strong><\/p><p><strong>1.1<\/strong> These TOU describe the rights and obligations of users and DelivrEx Go regarding the use of the Application.<br \/><strong>1.2<\/strong> The Application connects users seeking services (\u201cUsers\u201d) with independent individuals acting as Couriers (\u201cCouriers\u201d). DelivrEx Go facilitates the connection and the transactions between Users and Couriers but is not a party to the contracts entered into between them.<\/p><p><strong>Article 2 \u2014 Role of DelivrEx Go<\/strong><\/p><p><strong>2.1<\/strong> DelivrEx Go provides a platform enabling the posting of requests, acceptance of requests, communication between parties, management of transactions, and completion of deliveries.<br \/><strong>2.2<\/strong> DelivrEx Go is neither the buyer nor the seller nor the courier of the ordered products. Responsibility for purchasing, transport, and delivery lies exclusively with the contracting parties (User and Courier).<br \/><strong>2.3<\/strong> DelivrEx Go does not act as an agent, representative, or intermediary on behalf of Users or Couriers and assumes no contractual responsibility for goods or services provided by users or couriers.<br \/><strong>2.4<\/strong> DelivrEx Go is not a financial institution or payment institution. Any amounts exchanged between User and Courier are exclusively owed between these parties, and DelivrEx Go acts solely as a technological intermediation platform.<\/p><p><strong>Article 3 \u2014 Acceptance and access<\/strong><\/p><p><strong>3.1<\/strong> Access to the Application requires creating a user account. You agree to provide accurate, complete, and up-to-date information.<br \/><strong>3.2<\/strong> You are solely responsible for maintaining the confidentiality of your login details (email address, password) and for any activity conducted through your account. You must immediately notify DelivrEx Go of any unauthorized use of your account.<br \/><strong>3.3<\/strong> You agree not to allow minors (under 18 years of age) to use your account; the Application is strictly restricted to adults.<br \/><strong>3.4<\/strong> Users must have a valid payment method registered in their own name when completing a transaction. DelivrEx Go may verify the validity of the payment method or request additional documentation at any time.<\/p><p><strong>3.5 <\/strong>Acceptance of these TOU and the General Service Conditions (GSC) is mandatory:<br \/>\u2013 for the User, before validating and publishing a listing;<br \/>\u2013 for the Courier, before accepting a listing.<\/p><p>Any publication or acceptance of a listing constitutes full and complete acceptance of the TOU and GSC in force.<\/p><p><strong>Article 4 \u2014 User obligations<\/strong><\/p><p><strong>4.1<\/strong> You agree to use the Application in accordance with the law, these TOU, and standards of good conduct.<br \/><strong>4.2<\/strong> It is strictly prohibited to:<br \/>\u2022 publish or offer illegal, dangerous, counterfeit, or prohibited products or services;<br \/>\u2022 impersonate a third party or provide false information;<br \/>\u2022 disrupt, alter, or attempt to alter the functioning of the Application;<br \/>\u2022 send content that is offensive, defamatory, threatening, pornographic, or discriminatory;<br \/>\u2022 engage in spam, unsolicited commercial solicitations, or mass prospecting.<\/p><p><strong>4.3<\/strong> The user is responsible for the accuracy of the information provided (product description, price, link, photo, delivery address, etc.). Any inaccurate information may result in removal of the listing or account termination.<\/p><p><strong>Article 5 \u2014 Accounts and documentation<\/strong><\/p><p><strong>5.1<\/strong> DelivrEx Go may, at any time and for security reasons, request proof of identity, proof of residence, or any other document necessary to verify the identity and legitimacy of users.<br \/><strong>5.2<\/strong> Refusal to provide the requested documentation may result in account suspension or deletion.<\/p><p><strong>Article 6 \u2014 Intellectual property and brand usage<\/strong><\/p><p><strong>6.1<\/strong> All elements of the Application (design, logos, text, icons, source code) are the exclusive property of DelivrEx Go and\/or its partners and are protected by intellectual property laws.<br \/><strong>6.2<\/strong> It is forbidden to reproduce, copy, modify, integrate, display, or use any part of the Application, its trademarks, or content without prior written authorization. Framing or the use of meta-tags incorporating the DelivrEx Go brand is prohibited without written consent.<\/p><p><strong>Article 7 \u2014 User-generated content<\/strong><\/p><p><strong>7.1<\/strong> Users retain ownership of the content they publish but grant DelivrEx Go a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute such content as part of the operation of the Application.<br \/><strong>7.2<\/strong> Users warrant that they hold the rights necessary to publish the content and shall indemnify DelivrEx Go against any claim relating to the infringement of third-party rights.<br \/>The user remains solely responsible for the content, photographs, links, descriptions, information, or documents that they publish, transmit, or make available through the Application, and warrants that such content does not infringe third-party rights or violate applicable regulations.<br \/><strong>7.3<\/strong> DelivrEx Go reserves the right to delete any content that violates these TOU or applicable law.<\/p><p><strong>Article 8 \u2014 Transactions and liability<\/strong><\/p><p><strong>8.1<\/strong> The details of a transaction (products, location, date, courier commission, service fees) are defined by the listing and the exchange between User and Courier. Once a listing is accepted by a Courier, a binding transaction is formed between the two parties.<br \/><strong>8.2<\/strong> DelivrEx Go does not guarantee the conformity, quality, safety, or availability of products purchased by Couriers.<br \/><strong>8.3<\/strong> DelivrEx Go cannot be held liable for direct or indirect damage, losses, or harm resulting from a transaction between User and Courier, except where required by mandatory law.<br \/><strong>8.4<\/strong> DelivrEx Go is not responsible for pricing errors or inaccurate indications or descriptions provided by Users in listings.<\/p><p><strong>8.5<\/strong> DelivrEx Go does not guarantee that a listing will be accepted by a Courier, that a User will find an available Courier, or that a transaction will actually result in a delivery.<\/p><p><strong>Article 9 \u2014 Suspension, blocking, and account deletion<\/strong><\/p><p><strong>9.1<\/strong> DelivrEx Go reserves the right to suspend, restrict, block, or delete an account in case of violation of the TOU, applicable laws, or for security reasons.<br \/><strong>9.2<\/strong> In the event of fraudulent behavior or serious misconduct, DelivrEx Go may take any appropriate measure, including reporting the matter to competent authorities.<br \/><strong>9.3<\/strong> <strong>Deletion due to prolonged inactivity<\/strong><br \/>DelivrEx Go reserves the right to suspend or delete any account that has remained inactive for an extended period.<br \/>The user will receive a thirty (30) day notice before permanent deletion, inviting them to reconnect.<br \/>No deletion will occur while transactions are ongoing, to ensure the complete execution of contractual commitments.<br \/>If inactivity persists after the notice period and no transactions are pending, the account may be permanently deleted.<br \/>The deletion of an inactive account does not entitle the user to reimbursement of any fees previously paid.<\/p><p><strong>9.4<\/strong> The user remains responsible for obligations incurred before account closure. No refund of usage fees will be made in case of suspension or deletion, including due to violation of the TOU\/GSC.<\/p><p><strong>9.5 Fraud, abuse and circumvention<\/strong><br \/>Any attempt to commit fraud, abuse the service, manipulate the operation of the Application, or circumvent these Terms may result in the immediate suspension, restriction, or permanent termination of the account, without prior notice or compensation, and without prejudice to any legal action.<\/p><p><strong>Reporting to authorities<\/strong><br \/>In the event of proven fraud, illegal activity, attempted fraud, or misuse of the Application, DelivrEx Go reserves the right to disclose any relevant information to the competent authorities, in accordance with applicable law.<\/p><p><strong>Article 10 \u2014 Modifications to the Application and TOU<\/strong><\/p><p><strong>10.1<\/strong> DelivrEx Go may modify, suspend, or discontinue all or part of the Application, temporarily or permanently, without prior notice.<br \/><strong>10.2<\/strong> DelivrEx Go reserves the right to amend these TOU; modifications will be published through the Application. Continued use after publication constitutes acceptance of the new TOU.<\/p><p><strong>10.3<\/strong> Certain functionalities of the Application may be added, modified, restricted, suspended, or removed at any time, temporarily or permanently, without giving rise to any compensation.<\/p><p><strong>10.4<\/strong> Certain functionalities of the Application may depend on third-party services (including connection services, notifications, mapping, hosting, messaging, or payment services). DelivrEx Go shall not be held liable for interruptions, limitations, unavailability, or malfunctions attributable to such third-party services.<\/p><p><strong>10.5<\/strong> <strong>Service availability and maintenance<\/strong><br \/>DelivrEx Go does not guarantee continuous or uninterrupted availability of the Application.<br \/>The Application may be temporarily unavailable due to maintenance, updates, technical improvements, or for any other operational reason, without prior notice and without entitlement to compensation.<\/p><p><strong>Article 11 \u2014 Warranties and limitation of liability<\/strong><\/p><p><strong>11.1<\/strong> The Application is provided \u201cas is.\u201d DelivrEx Go does not guarantee continuous availability, absence of interruptions, technical errors, or disruptions. No express or implied warranty is offered regarding suitability for a particular purpose, absence of errors, or continuity of service.<br \/><strong>11.2<\/strong> To the extent permitted by law, DelivrEx Go is only liable for direct and proven damages caused by a malfunction of the Application.<br \/>In all cases, the maximum amount of compensation that may be owed by DelivrEx Go shall not exceed the total amount paid by the user to DelivrEx Go during the six (6) months preceding the incident that caused the damage.<br \/><strong>11.3<\/strong> DelivrEx Go shall not be liable for loss of profit, indirect damage, intangible harm, or losses resulting from a transaction between User and Courier.<br \/><strong>11.4<\/strong> DelivrEx Go cannot be held liable in cases of non-performance or improper performance due to force majeure or events beyond its reasonable control.<\/p><p><strong>11.5<\/strong> DelivrEx Go shall not be held liable for any loss of data, delay, transmission failure, technical malfunction, temporary unavailability, bug, software or hardware incompatibility, or interruption of the service beyond its reasonable control or attributable to a third party, a network, or an external service.<\/p><p><strong>Article 12 \u2014 Security and confidentiality<\/strong><\/p><p><strong>12.1<\/strong> DelivrEx Go implements reasonable technical and organizational measures to protect personal data.<br \/><strong>12.2<\/strong> Users agree to adopt basic security measures (strong password, updated profile information) and report any anomalies.<br \/><strong>12.3<\/strong> The processing of personal data is governed by the Privacy Policy published within the Application.<\/p><p><strong>12.4 Security limitations<\/strong><br \/>While DelivrEx Go implements reasonable technical and organizational security measures to protect personal data, no method of electronic transmission or storage is completely secure.<br \/>Accordingly, DelivrEx Go cannot guarantee the absolute security of data transmitted or stored through the Application.<\/p><p><strong>Article 13 \u2014 Technical prohibitions<\/strong><\/p><p><strong>13.1<\/strong> The use of any tool intended to hide, modify, falsify, or conceal the IP address, real location, or technical connection data (including VPNs, proxies, or anonymous networks) is strictly prohibited when using the Application.<br \/>This prohibition is justified in particular by the fact that certain essential features of DelivrEx Go rely on the user\u2019s real location, especially in connection with deliveries, user matching, and the execution of transactions.<br \/>DelivrEx Go reserves the right to deny access, restrict certain features, suspend, or terminate any account in the event of the use of such tools.<\/p><p><strong>13.2<\/strong> Reverse engineering, decompilation, disassembly, or any attempt to reproduce the Application\u2019s source code is prohibited to the extent permitted by law.<\/p><p><strong>Article 14 \u2014 Notifications and complaints<\/strong><\/p><p><strong>14.1<\/strong> Users are invited to report any unlawful, offensive, or defamatory content through the complaint form available in the Application. DelivrEx Go will carry out the necessary checks and may suspend the author of the content for the duration of the investigation.<br \/><strong>14.2<\/strong> Complaints related to a delivery or transaction must be submitted within the deadlines set by the Conditions of Service.<br \/><strong>14.3<\/strong> Any communication sent by DelivrEx Go via the Application, internal notification, or email is deemed received by the User at the time of sending.<\/p><p><strong>14.4 Official notifications and communications<\/strong><br \/>DelivrEx Go may contact the user through in-app notifications, email, or any other communication channel available through the Application.<br \/>Such communications are deemed to be received as soon as they are made available in the Application or sent to the email address associated with the user\u2019s account.<\/p><p><strong>Article 15 \u2014 Duration and termination<\/strong><\/p><p><strong>15.1<\/strong> These TOU apply for the entire duration of use of the Application.<br \/><strong>15.2<\/strong> Users may delete their account at any time through the options available in the Application, subject to ongoing obligations or transactions.<\/p><p><strong>Article 16 \u2014 Miscellaneous provisions<\/strong><\/p><p><strong>16.1<\/strong> Partial invalidity: If any clause of the TOU is deemed invalid, the remaining clauses remain fully valid.<br \/><strong>16.2<\/strong> No waiver: Failure by DelivrEx Go to enforce a clause immediately does not constitute a waiver of its future enforcement.<br \/><strong>16.3<\/strong> The TOU and GSC constitute the entire agreement between the User and DelivrEx Go and replace any prior oral or written agreement.<\/p><p><strong>16.4<\/strong> Records, logs, histories, technical data, timestamps, confirmations, notifications, internal messages, and any information stored by DelivrEx Go in digital form may be used as evidence in the event of a dispute, complaint, or verification.<\/p><p><strong>Article 17 \u2014 Governing law and jurisdiction<\/strong><\/p><p><strong>17.1<\/strong> These Terms and Conditions are governed by the laws of the country where DelivrEx Go is domiciled, namely Hong Kong.<br \/>However, where mandatory legal provisions of the user\u2019s country of residence apply (particularly in relation to consumer protection or personal data protection), such provisions shall remain applicable.<br \/><strong>17.2<\/strong> In case of dispute, the parties will attempt amicable resolution before any legal action. Failing amicable agreement, the dispute shall be submitted to the competent courts according to applicable law.<\/p><p><strong>17.3<\/strong> In case of any inconsistency between the language versions, the French version shall prevail.<\/p><p><strong>Contact<\/strong><\/p><p>For any questions about these TOU, privacy, or use of the Application, please use the contact form available by email at <strong><a href=\"mailto:contact@delivrexgo.com\">contact@delivrexgo.com<\/a><\/strong> or the \u201cMy Account\u201d section in the Application.<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p>\u00a0<\/p><p><strong>\ud83d\udfe6<\/strong><strong> GENERAL SERVICE CONDITIONS (GSC)<\/strong><\/p><p>The General Service Conditions complement the TOU and govern the rules of operation for transactions between Users (\u201cRequesters\u201d or \u201cRecipients\u201d) and Couriers.<\/p><p><strong>DEFINITIONS<\/strong><\/p><p>For clarity, the following terms have the meaning described below:<\/p><ul><li><strong>User \/ Requester \/ Recipient:<\/strong> person requesting the purchase and delivery of one or more products through the Application.<\/li><li><strong>Courier:<\/strong> person accepting to purchase the requested products and deliver them to the User.<\/li><li><strong>Listing:<\/strong> purchase and delivery request created by a User.<\/li><li><strong>Transaction:<\/strong> listing that has been accepted by a Courier. It constitutes the agreement between both parties.<\/li><li><strong>Courier\u2019s Commission:<\/strong> amount the User agrees to pay the Courier upon delivery, as compensation for the service.<\/li><li><strong>Usage Fees:<\/strong> fees charged by the Application and banking fees related to the <strong>connection between Users and Couriers<\/strong>. These fees are paid at the time the listing is published and are non-refundable.<\/li><li><strong>Currency: <\/strong>Unless otherwise stated, all amounts displayed in the Application are expressed in euros (\u20ac).<\/li><\/ul><p><strong>\ud83d\udfe9<\/strong><strong> 1. HOW TO ORDER (USERS)<\/strong><\/p><p><strong>1.1. Main menu<\/strong><\/p><p>The User selects the <strong>\u201cUser\u201d<\/strong> mode to create a purchase and delivery request.<\/p><p><strong>1.2. Description of requested products<\/strong><\/p><p>The User must provide the following for each product:<\/p><ul><li>name;<\/li><li>photo;<\/li><li>link allowing the product to be verified;<\/li><li>price;<\/li><li>quantity (max. 10 per product);<\/li><li>location where the product can be found (optional);<\/li><li>additional information (optional).<\/li><\/ul><p>Each listing may contain <strong>up to 5 products.<\/strong><\/p><p><strong>1.2.1. Accuracy of the information provided<\/strong><\/p><p>The User is solely responsible for the accuracy of the information provided when creating a listing (product description, price, link, photos, delivery address, etc.).<\/p><p>Any incomplete, incorrect or misleading information that results in the impossibility of purchase, incorrect delivery, or unnecessary travel by the Deliverer shall be the sole responsibility of the User.<\/p><p>In such cases, the Deliverer may report the issue through the Application. DelivrEx Go may review the available information and, where appropriate, take suitable measures regarding the account concerned, in accordance with these Terms.<\/p><p><strong>1.3. Delivery details and fees<\/strong><\/p><p>The User must then specify:<\/p><ul><li><strong>Courier\u2019s Commission <\/strong>(minimum: \u20ac1.00). This commission may, where applicable, include costs related to the customs clearance of the products, in accordance with the General Service Conditions;<\/li><li><strong>Total amount to be paid to the Courier<\/strong> upon delivery: sum of products + commission;<\/li><li><strong>Usage fees<\/strong>: automatically calculated, paid immediately, and non-refundable;<\/li><li><strong>Delivery address<\/strong>;<\/li><li><strong>Allowed Courier gender<\/strong>: Male \/ Female \/ Both;<\/li><li><strong>Acceptance deadline<\/strong> (max. 1 year);<\/li><li><strong>Delivery deadline<\/strong> (max. 1 year).<\/li><\/ul><p>If no Courier accepts the listing before the acceptance deadline, the listing expires and is no longer visible.<\/p><p><strong>1.4. Payment and publication of the listing<\/strong><\/p><p>The User must:<\/p><ul><li>accept the TOU and GSC;<\/li><li>pay the usage fees.<\/li><\/ul><p>Once the payment is validated:<\/p><p>\u27a1\ufe0f <strong>the listing is published and cannot be cancelled.<\/strong><\/p><p><strong>Payment disputes and chargebacks<\/strong><br \/>DelivrEx Go shall not be held liable for banking disputes, payment rejections, payment disputes (including chargebacks), or fraudulent use of payment methods.<br \/>Any such disputes shall be handled exclusively between the user and their bank or payment service provider.<\/p><p><strong>Payment fraud and abuse<\/strong><br \/>DelivrEx Go reserves the right to suspend or terminate an account in the event of suspected payment fraud, abusive chargebacks, fraudulent use of a payment method, or any attempt to bypass the payment system.<\/p><p><strong>1.5. Modification proposal by a Courier<\/strong><\/p><p>A Courier may <strong>propose a modification<\/strong> of any of the following elements:<\/p><ul><li>product photo;<\/li><li>web link;<\/li><li>price;<\/li><li>quantity;<\/li><li>Courier\u2019s commission;<\/li><li>delivery address.<\/li><\/ul><p><strong>During the modification process, the listing becomes invisible to other Couriers.<\/strong><\/p><p>The Courier must also indicate:<\/p><ul><li><strong>the planned delivery date and time,<\/strong> which must fall between:<\/li><\/ul><ul><li>the date on which the proposal is submitted; and<\/li><li>a date no later than one year after the listing\u2019s publication date.<\/li><\/ul><p>Once the proposal is sent:<\/p><ul><li><strong>If the User declines:<\/strong> the listing becomes visible again to other Couriers;<\/li><li><strong>If the User accepts:<\/strong><\/li><\/ul><ul><li>the User pays any difference if applicable;<\/li><li>the validated proposal becomes a <strong>binding transaction<\/strong>, which starts immediately under the updated conditions.<\/li><\/ul><p><strong>This feature is available only when displayed in the Application. Until it appears in the interface, Couriers cannot propose modifications.<\/strong><\/p><p><strong>1.6. Direct acceptance by a Courier<\/strong><\/p><p>The Courier may also <strong>accept the listing as published<\/strong>, without proposing any modification.<\/p><p>The Courier must then set:<\/p><ul><li><strong>the delivery date and time,<\/strong><\/li><li>which must fall between:<\/li><\/ul><ul><li>the date on which the listing is accepted; and<\/li><li>the User&#8217;s delivery deadline.<\/li><\/ul><p>Once accepted:<\/p><ul><li>a transaction begins immediately between the User and the Courier;<\/li><\/ul><p><strong>1.7. Communication between User and Courier<\/strong><\/p><p>An <strong>internal messaging<\/strong> system <strong>(Chat)<\/strong> allows both parties to exchange messages.<br \/>Messages exchanged via the internal chat have no contractual value and cannot modify the terms of the transaction. However, they may serve as supporting evidence in case of disputes, claims, or verifications conducted by DelivrEx Go.<\/p><p><strong>1.8. Finalizing the transaction<\/strong><\/p><p>The Courier has a <strong>unique 10-character code.<\/strong><\/p><p>\u27a1\ufe0f The Recipient must enter this code in the Application to finalize the transaction.<\/p><p>A stable Internet connection is required for proper validation.<\/p><p><strong>1.8.1. Legal value of the validation code<\/strong><\/p><p>The entry of the validation code provided by the Deliverer into the Application constitutes irrevocable confirmation of receipt of the products by the Recipient and results in the final completion of the transaction.<\/p><p>Once the code has been entered and validated, the transaction is considered completed, and no claim regarding non-receipt of the products shall be accepted, except in cases of proven fraud, coercion, or a proven malfunction of the Application.<\/p><p><strong>1.9. Missed deadlines<\/strong><\/p><ol><li><strong>a) Scheduled delivery date exceeded (but before the delivery deadline)<\/strong><\/li><\/ol><p>A questionnaire is sent to both parties.<br \/>If no reply \u2192 considered a breach of contract.<br \/>The transaction remains active and may still be finalized by entering the code.<\/p><ol><li><strong>b) Delivery deadline exceeded<\/strong><\/li><\/ol><p>Once the delivery deadline is exceeded:<\/p><ul><li><strong>the validation code can no longer be entered<\/strong> by the Recipient;<\/li><li><strong>the Recipient may file a complaint<\/strong> via the application;<\/li><li><strong>the Courier may also file a complaint.<\/strong><\/li><\/ul><p><strong>The administrator examines the situation and may close the transaction only in the following cases:<\/strong><\/p><ol><li><strong>Both parties expressly confirm that the transaction was completed<\/strong> despite the deadline;<\/li><li><strong>One party acknowledges an agreement or completion<\/strong> of the transaction;<\/li><li><strong>After reviewing complaints and available evidence, the administrator determines <\/strong>that one party is at fault. In such case, the transaction shall be closed in accordance with the administrator\u2019s decision.<\/li><\/ol><p><strong>DelivrEx Go is not required to intervene in disputes between Users and Couriers. The administrator may close a transaction only in accordance with the GSC rules and does not guarantee an outcome favorable to either party.<\/strong><\/p><p><strong>1.10. Ratings<\/strong><\/p><p>After completion, the Recipient may rate:<\/p><ul><li>the Application (once per transaction);<\/li><li>the Courier (once per transaction).<\/li><\/ul><p>The ratings given are visible only when using the Application in Courier mode, and only in the section corresponding to published listings.<br \/>They are not publicly visible elsewhere in the Application.<\/p><p><strong>1.11. Multiple listings<\/strong><\/p><p>Users may create and publish multiple listings simultaneously, provided they comply with the TOU and GSC. Each listing is treated independently.<\/p><p><strong>\ud83d\udfe5<\/strong><strong> 2. HOW TO DELIVER (COURIERS)<\/strong><\/p><p><strong>2.0. Courier status<\/strong><\/p><p>The Courier acts as an independent contractor and is solely responsible for complying with fiscal, social, and legal obligations.<br \/>No employment, agency, or representation relationship is created between DelivrEx Go and Couriers.<\/p><p><strong>2.1. Choosing the destination<\/strong><\/p><p>The Courier selects the <strong>\u201cCourier\u201d<\/strong> mode and indicates the desired <strong>delivery city<\/strong>. After entering the destination, they must click \u201cShow List\u201d to access User listings in that area.<\/p><p><strong>2.2. List of available listings<\/strong><\/p><p>For each listing, the Courier sees:<\/p><ul><li>listing details;<\/li><li>commission offered to the courier;<\/li><li>exact delivery address;<\/li><li>acceptance deadline;<\/li><li>delivery deadline.<\/li><\/ul><p><strong>2.3. Sorting listings<\/strong><\/p><p>Couriers may sort listings by:<\/p><ul><li><strong>publication date:<\/strong> newest to oldest (or reversed via \u201cSwitch\u201d);<\/li><li><strong>User rating:<\/strong> highest to lowest;<\/li><li><strong>remaining display time:<\/strong> expiring soonest first;<\/li><li><strong>delivery deadline:<\/strong> nearest first;<\/li><li><strong>total product price:<\/strong> descending order, with optional maximum limit;<\/li><li><strong>commission offered:<\/strong> descending order, with optional minimum commission.<\/li><\/ul><p>The order of each sort can be reversed using the \u201cSwitch\u201d button.<\/p><p><strong>2.4. Acceptance or modification proposal<\/strong><\/p><p>Couriers may:<\/p><p>\u2714\ufe0f <strong>Accept the listing<\/strong><\/p><p>\u2192 They choose the delivery date and time within the allowed limits.<br \/>\u2192 The transaction starts immediately.<br \/>\u2192 It cannot be cancelled.<\/p><p>\u2714\ufe0f <strong>Propose a modification<\/strong><\/p><p>They may modify:<\/p><ul><li>photo, web link, price, quantity;<\/li><li>commission;<\/li><li>delivery address.<\/li><\/ul><p>A reason is required.<\/p><p>If <strong>accepted by the Recipient<\/strong> \u2192 <strong>active transaction<\/strong>.<br \/>If refused by the Recipient \u2192 proposal rejected.<\/p><p><strong>2.5. Courier obligations<\/strong><\/p><p>The Courier must have sufficient funds to purchase the products before accepting or modifying a listing.<\/p><p>Once accepted, the Courier must:<br \/>\u2022 purchase the products;<br \/>\u2022 transport and deliver them;<br \/>\u2022 respect the scheduled delivery date and time;<br \/>\u2022 request any change of delivery date using the <strong>\u201cChange Delivery Date\u201d<\/strong> feature.<\/p><p><strong>2.6. Messaging between Courier and User<\/strong><\/p><p>The Courier may exchange messages with the User as soon as a transaction is in progress.<br \/>These exchanges take place via the \u201cChat\u201d button available on the transaction summary page.<\/p><p>Messages cannot be used to change the delivery date or time.<br \/>Any request to modify the appointment must be made exclusively through the \u201cChange Delivery Date\u201d feature and only becomes effective once validated by the User.<\/p><p>Messages exchanged through the internal messaging system have no contractual value and cannot modify the terms of the transaction. However, they may be used as evidence in the event of a dispute, claim, or verification conducted by DelivrEx Go.<\/p><p><strong>2.7. End-of-transaction code<\/strong><\/p><p>The Courier must present their <strong>exchange code<\/strong> to the Recipient.<br \/>Without entering the code \u2192 the transaction is not finalized.<\/p><p><strong>2.8. Missed deadlines<\/strong><\/p><p>Same rules as for Users:<\/p><ul><li>questionnaire if scheduled delivery date is exceeded;<\/li><li>complaint possible if final deadline is exceeded;<\/li><li>final decision by the administrator.<\/li><\/ul><p><strong>2.9. Ratings<\/strong><\/p><p>The Courier may rate:<\/p><ul><li>the Application;<\/li><li>the Recipient.<\/li><\/ul><p>One rating per transaction.<\/p><p>The ratings given are visible only in certain parts of the application, specifically in the published listings section accessible to Couriers.<\/p><p><strong>\ud83d\udfe8<\/strong><strong> 3. BREACH OF CONTRACT<\/strong><\/p><p>A breach of contract notably includes:<\/p><ul><li>absence at delivery;<\/li><li>delay;<\/li><li>failure to provide or enter the code;<\/li><li>improper transport;<\/li><li>violation of TOU\/GSC;<\/li><li>product damage or loss.<\/li><\/ul><p>Possible consequences:<\/p><ul><li>negative rating visible to others;<\/li><li>suspension;<\/li><li>account deletion.<\/li><\/ul><p><strong>3.1. Breach by the Recipient<\/strong><\/p><p>If the Recipient cancels, is absent, or fails to respect the appointment:<\/p><ul><li>no refund of fees;<\/li><li>negative rating;<\/li><li>obligation to resolve the issue directly with the Courier;<\/li><li>account suspension or deletion.<\/li><\/ul><p><strong>3.2. Breach by the Courier<\/strong><\/p><p>If the Courier cancels, is absent, or fails to comply:<\/p><ul><li>negative rating;<\/li><li>obligation to resolve the issue with the Recipient;<\/li><li>account suspension or deletion.<\/li><\/ul><p><strong>3.3. Suspension or deletion of the User account<\/strong><\/p><p>In the event of the User\u2019s failure to comply with a transaction (absence at the appointment, unjustified delay, refusal to receive the goods, failure to pay the amounts due to the Courier upon delivery, inappropriate behavior, or any breach of their contractual obligations), DelivrEx Go reserves the right to temporarily or permanently suspend the User\u2019s account, without compensation and after verifying the facts.<\/p><p><strong>3.4. Suspension or deletion of the Courier account<\/strong><\/p><p>In the event of the Courier\u2019s failure to comply with a transaction (unjustified delay, absence at the appointment, inability to complete the purchase or delivery, failure to respect the declared date and time, inappropriate behavior, or any breach of their contractual obligations), DelivrEx Go reserves the right to temporarily or permanently suspend the Courier\u2019s account, without compensation and after verifying the facts.<\/p><p><strong>3.5. Force majeure<\/strong><\/p><p>Neither party shall be held liable for any delay or failure to perform its obligations when such delay or failure results from a force majeure event, as defined by applicable law or case law, including but not limited to natural disasters, extreme weather events, strikes, social unrest, widespread network failures, decisions by public authorities, or any event beyond the reasonable control of the parties.<br \/>In such cases, the delivery appointment agreed between the User and the Deliverer must be rescheduled by mutual agreement using the features provided in the Application.<\/p><p><strong>\ud83d\udfeb<\/strong><strong> 4. GOODS, LIABILITY AND CUSTOMS<\/strong><\/p><p><strong>4.1. Prohibited products<\/strong><\/p><p>It is strictly forbidden to request or transport:<\/p><ul><li>narcotics;<\/li><li>dangerous substances;<\/li><li>prohibited goods;<\/li><li>counterfeits;<\/li><li>weapons and ammunition;<\/li><li>protected or regulated products.<\/li><\/ul><p>Each country has its own restrictions; users must verify legality.<\/p><p><strong>4.2. Personal use only<\/strong><\/p><p>Requested products must be for <strong>personal use<\/strong> only, never commercial.<\/p><p><strong>4.3. Customs duties and taxes<\/strong><\/p><p>DelivrEx Go is not responsible for:<\/p><ul><li>customs taxes;<\/li><li>controls;<\/li><li>additional charges;<\/li><li>confiscations.<\/li><\/ul><p>The Courier is fully responsible for transported goods until delivery to the Recipient.<\/p><p>All customs-related taxes, checks, retention, or charges are the sole responsibility of the Courier. DelivrEx Go does not intervene in international transport and cannot be held responsible for any consequences related to customs clearance.<\/p><p><strong>4.3.1. Inclusion of Customs Clearance Fees in the Courier\u2019s Commission<\/strong><\/p><p>The Courier\u2019s commission, as defined at the time the listing is created or modified, <strong>may include all or part of the costs related to the customs clearance of the requested products<\/strong>, including but not limited to customs duties, taxes, administrative fees, or any charges required by the competent authorities.<\/p><p>The amount of this commission is freely agreed upon and accepted between the User and the Courier prior to the validation of the transaction.<\/p><p>DelivrEx Go does not intervene in the determination, calculation, or payment of customs clearance fees, which are <strong>exclusively governed by the agreement concluded between the User and the Courier<\/strong>.<\/p><p>Under no circumstances shall DelivrEx Go be held liable for the amounts applied, variations in customs fees, administrative decisions, or any consequences related to customs clearance.<\/p><p><strong>Variation due to customs clearance<\/strong><br \/>The Deliverer\u2019s commission displayed in the Application is set by the Requester based on the information available at the time the request is published.<br \/>However, where the delivery involves customs clearance, the final amount payable to the Deliverer may vary if the actual customs fees (customs duties, taxes, administrative charges) are higher or different from the initial estimate.<br \/>Such costs are governed exclusively by the agreement between the User and the Deliverer, in accordance with these Terms, and shall under no circumstances give rise to any liability on the part of DelivrEx Go.<\/p><p><strong>4.4. Integrity of goods<\/strong><\/p><p>DelivrEx Go does not guarantee:<\/p><ul><li>physical condition of transported goods;<\/li><li>absence of damage;<\/li><li>any issues occurring during transport.<\/li><\/ul><p>The Courier is fully responsible.<\/p><p><strong>\ud83d\udfea<\/strong><strong> 5. ARCHIVING AND CLAIMS<\/strong><\/p><p><strong>5.1. Archiving<\/strong><\/p><p>Notifications, messages, and transactions may be stored for a minimum of <strong>7 days after completion<\/strong>, then deleted at any time beyond this period.<\/p><p>DelivrEx Go may retain this data longer when necessary, notably to:<\/p><ul><li>comply with legal, regulatory, tax, or accounting obligations;<\/li><li>respond to authority requests;<\/li><li>prevent or detect fraud or illegal activity;<\/li><li>process a claim or resolve a dispute;<\/li><li>ensure proper application of the TOU and GSC.<\/li><\/ul><p>Once these purposes are fulfilled, the data is permanently deleted.<\/p><p><strong>Data retention in case of dispute<\/strong><br \/>In the event of a dispute, claim, investigation, or legal proceeding, the necessary data may be retained for the entire duration of the procedure and until its final resolution, even if this exceeds the initially specified retention periods.<\/p><p><strong>5.2. Claims<\/strong><\/p><p>The deadlines are strict:<br \/>\u2022 <strong>within a maximum period of 48 hours after the scheduled delivery date<\/strong>, if the transaction has not been finalized;<br \/>\u2022 <strong>within a maximum period of 48 hours after completion<\/strong>, for any other claim.<\/p><p>After these deadlines, no claim will be processed.<\/p><p><strong>Mediation and assistance<\/strong><br \/>DelivrEx Go may, at its sole discretion, offer assistance or mediation between the parties in the event of a dispute, without this constituting any obligation or guarantee of resolution.<\/p><p><strong>5.3. DelivrEx Go response time<\/strong><\/p><p>DelivrEx Go handles claims, support requests, and reports within a reasonable timeframe.<br \/>This may vary depending on complexity, workload, or required verifications.<br \/>DelivrEx Go processes requests to the best of its ability and cannot be held liable for any potential delays.<\/p><p><strong>\ud83d\udfeb<\/strong><strong> 6. RATINGS AND REVIEWS<\/strong><\/p><p><strong>6.1. Rating system<\/strong><\/p><p>Each user may submit:<\/p><ul><li>a rating (1 to 5 stars);<\/li><li>a written review.<\/li><\/ul><p>Ratings contribute to an average visible within the Application.<br \/>Visibility is restricted to Courier mode in the section displaying published listings.<\/p><p><strong>6.2. Review management<\/strong><\/p><p>DelivrEx Go may delete or hide a review:<\/p><ul><li>after long inactivity;<\/li><li>in case of offensive, defamatory, or inappropriate content;<\/li><li>where deletion is necessary for the security or integrity of the service.<\/li><\/ul><p>DelivrEx Go also reserves the right not to publish, to remove, or to hide any rating, review, or comment where there is a legitimate doubt as to its authenticity, relevance, lawfulness, or compliance with these terms.<\/p><p><strong>6.3.
